These General Terms and Conditions (hereinafter referred to as “GTC”) set out the basic rules of the legal relationship between the accommodation provider (hereinafter referred to as “the Service Provider”) and the person using the accommodation booking system (hereinafter referred to as “the Guest”) provided through www.yachtcamping.hu (hereinafter referred to as “the Booking System”), and in this context the rights and obligations of the Service Provider and the Guest.

All natural and legal persons are entitled to make a purchase using the Booking System if they accept and consider the stipulations of the GTC as binding upon them.

1. Basic information

1.1 The web address of the accommodation booking system is: www.yachtcamping.hu

1.2 The guest enters into a contractual relationship with the operator of the booking system when concluding a contract through the booking system. Service provider’s data are the following:

2. Services offered on the accommodation booking system

The accommodation booking system exclusively offers the accommodation services of Yacht Camping, physically located at H-8220 Balatonalmádi, Véghely Dezső utca 18, Hungary.

3. Contracting process

When purchasing through the booking system, the following technical steps are required/available to conclude the contract:

3.1 The guest can start the booking process by clicking on the “Online booking” tab on the main page, or by clicking on the “Instant online booking” button in the “Accommodation offer” menu, or by clicking on “… Reserve” in the “Our Prices” menu. After clicking, the guest will be taken to the “Booking” menu.

3.2 In the “Booking” menu, the guest can enter the planned arrival and departure dates, the number of guests and the type of accommodation, or, if they have a promotional code, they can input that.

3.3 The guest can click on the “View offers” button to view the offers that meet their needs. The guest will get an overview of the accommodation types and can also view the offer details and cancellation conditions separately.

3.4 The guest can select the offer he/she likes by clicking on the “Select” button for the offer, after which the optional “Extra Services” are displayed, further information on which can be found in the “Details” menu. Choosing an extra service is optional.

3.5 Once the offer has been selected, during the booking process, the guest can keep track of the services chosen and the exact amount they will have to pay for them on the on-screen offer summary.

3.6 The guest can click on the “Next” button at the bottom of the page to enter his/her personal details. When doing so, the guest enters his/her full name, e-mail address, telephone number, tax number in the case of non-natural entities, and address details. Once the details have been entered, the guest has the option to send a message to the campsite.

3.7 The guest can indicate the prepayment methods on the same form. They can choose to pay by credit card, bank transfer or prepayment from a “Szép” Card (Széchenyi Recreation Card). The guest also has the option to indicate their wish to receive promotional messages from the Service Provider.

3.8 By ticking the checkbox, the guest declares that he/she has read these General Terms and Conditions and the Privacy Policy. Without this acceptance, the booking cannot be sent.

3.9 The guest can finalise his/her booking by clicking on the “Finalise booking” button.

3.10 If the guest wishes to pay the deposit by card, he/she must click on the “Confirm booking” button:

After ordering the selected services, the guest will be redirected to the payment page of Unicredit Bank, where he/she can pay with his/her credit card through the most secure encrypted transaction currently available. All the customer has to do is select “pay by credit card” and enter the card number, expiry date and the verification code (CVC/CVV) on the back of the card on the Bank’s payment server. The Bank accepts embossed VISA and Mastercard, Visa Electron (at the discretion of the issuing bank) and Maestro cards for which a verification code (CVC) has been issued. If the guest’s Maestro card does not have one, please contact your bank.

We can only accept cards issued for electronic use only if the bank issuing the card authorises its use! Please check with your bank whether your card can be used for online purchases.

3.11 If you wish to settle your advance payment with a Szép-card:

After ordering the selected services, the guest will be redirected to the payment page of the Szép-card provider, where he/she can pay by Szép-card through the most secure encrypted transaction currently available. All the guest has to do is click on “Pay by Szép-card” when selecting the payment method and then enter the card number, expiry date and, if required by the Szép-card provider’s interface, the verification code on the back of the card on the provider’s bank payment server.

3.12 After sending the order, the guest will be notified immediately by electronic message that the order has been received by the Service Provider. The confirmation will include a summary of the details of the order. The confirmation of the order will only serve to inform the guest that his/her letter has been received. This confirmation does not imply that we have agreed to fulfil the customer’s order on the terms and conditions stated. If the electronic message confirming acceptance of the order is not received within 48 hours of the order being sent, the guest is released from any obligation to make an offer or to enter into a contract.

3.13 The contract is concluded when the Service Provider sends a second electronic message to the guest confirming that the order can be honoured.

3.14 Please be informed that the order placed in the booking system and the confirmation of the availability of the accommodation shall be deemed to have been received by the other party when it becomes available to the latter. The fact that the confirmation has become available is irrespective of when the confirmation was actually made known to the guest. For example, if the confirmation arrives illegible or in a spam folder due to a misconfiguration of the guest’s mail system, the confirmation is still considered accessible.

4. Ways and means of detecting and correcting data entry mistakes

4.1 During the purchase process in the booking system, before sending the order, the following tools are available to the guest to detect data entry errors: before finalising the order, i.e. clicking on the “Booking” button, the guest can review and correct his/her details, whereby he/she can cancel and correct the order.

4.2 When making a purchase in the booking system, before sending the order, the following tools are available to the guest to correct data entry errors:

a) The guest can close the website, in this case the information recorded will be deleted.

b) Prior to finalising the order, the guest can either click on the back button or on the process buttons (in blue) at the top of the screen to go back to previous steps of the order process and correct the data entered.

c) The guest can change their personal data.

d) The guest can also change the quantity of the product.

e) The guest can click on the pencil icon in the summary menu to change the type of accommodation and other details.

5.       Further contracting information

5.1 The language of the contract is English, German, or Hungarian, according to the guest’s choice. The guest can choose the language of the website and thus the language of the contract by clicking on the flag icon in the top right corner of the home screen.

5.2 The contract concluded when purchasing through the booking system is not to be considered a written contract.

5.3 The Service Provider does not file and register the contract concluded through the booking system.

6. Prices indicated in the booking system

6.1 The booking system indicates gross purchase prices that include VAT.

6.2 The indicates gross purchase prices in the booking system do not include the amount of the tourist tax. Tourist tax is payable in cash on the spot for persons over 18 years of age. The amount of the services in excess of the deposit and the tourist tax must also be paid on the spot.

6.3 The Service Provider reserves the right to change the prices indicated in the booking system. The change will take effect upon publication in the booking system but will not affect the confirmed price of services already ordered.

6. 4 If an incorrect price is indicated in the booking system (for example, if the price of a service is HUF 0 or a price that would raise doubt in a reasonably informed guest acting with due care and diligence in the given situation), the Service Provider is not obliged to confirm the order placed at the incorrect price. If no confirmation is given for this reason, the Service Provider may offer the possibility of confirmation at the real price. If the guest does not wish to do so, he/she may withdraw from the contract.

7. Booking conditions

7.1 Arrival, occupation of confirmed accommodation: If for any reason the guest is unable to arrive on the starting date of the booking and provides prior written notice, we will keep the accommodation reserved for them for a maximum of 1 day. After this time, and in the event of non-notification, we will only be able to offer accommodation from the available vacancies, which may not match the guest’s original booking. Our accommodation can be occupied from 15:00 on the day of arrival and camping pitches from 12:00 on the day of arrival.

7.2 No pets are allowed in the holiday homes, mobile homes, or tents. Exceptions may be made for types of accommodation specifically offered as pet-friendly accommodation by the service provider.

7.3 Modification of the booking: in the case of bookings made through the booking system, the content of the booking can only be modified in writing with the Service Provider. After arrival, it is no longer possible to shorten the duration of the service, in such cases the full period ordered originally will be charged.

7.4 The difference between the accommodation price and the advance payment and any additional services to be used on site, as well as the tourist tax, must be paid at the campsite reception on the day of arrival.

7.5 Please bring all your booking documents with you on arrival.

7.6 Our campsite may charge the full amount of the accommodation fee as a deposit before the day of arrival.

7.7 In the case of holiday homes, mobile homes and tents for rent, a cash deposit must be paid on arrival (between HUF 10.000-25.000 depending on the type of accommodation).

7.8 The campsite has a barrier gate entry system, a proxy is required for entry/exit and a deposit for the proxy must be paid in cash.

7.9 The sizes of campsites shown in the information and on the map indicate a category, the actual sizes within the category may vary.

7.10 If you request a specific campsite or accommodation number, or make a specific personal request, we will do our best to fulfil your request, but no guarantees are given.

7.11 The campsite regulations contain important rules, which must be respected by the guest and all accompanying persons. On arrival, please read this document, which is posted on the campsite website and at various points around the campsite.

7.12 In order to ensure undisturbed stay, the entrance/gates of the Yacht Campsite are closed from 23.00 until 06.00. The night-time closing is valid during the entire opening hours. Arrival and departure are suspended, and vehicle traffic is prohibited during these periods. Pedestrian traffic is allowed during this period.

8. Terms of payment

When purchasing through the booking system, guests can pay using the following payment methods:

a, Bank transfer in advance. The bank transfer can be made to the following account number:

The booking will be considered final only if the deposit is received no later than 5 calendar days after the booking is sent. If the deposit is not received within this period, the booking will be considered null and void and will be cancelled without notice.

When transferring the money, please include the “Booking number” in the message field so that we can identify the amount.

It is advisable to send us a copy of the transfer by e-mail or post.

b, Bank card:

After ordering the selected services, the guest will be redirected to the payment page of Unicredit Bank, where he/she can pay with his/her card through the most secure encrypted transaction currently available. All the customer has to do is select “pay by card” and enter the card number, expiry date and the verification code (CVC/CVV) on the back of the card on the Bank’s payment server. The Bank accepts embossed VISA and Mastercard, Visa Electron (at the discretion of the issuing bank) and Maestro cards for which a verification code (CVC) has been issued. If the guest’s Maestro card does not have one, please contact your bank.

We can only accept cards issued for electronic use only if the bank issuing the card authorises its use! Please check with your bank whether your card can be used for online purchases.

c, By SZÉP-card:

The Service Provider accepts Szép-cards issued by OTP, K&H and MKB banks.

After ordering the selected services, the guest will be redirected to the payment page of the Szép-card provider, where he/she can pay by Szép-card through the most secure encrypted transaction currently available. All the guest has to do is click on “Pay by Szép-card” when selecting the payment method and then enter the card number, expiry date and, if required by the Szép-card provider’s interface, the verification code on the back of the card on the provider’s bank payment server.

9. Exercising the right of cancellation

Pursuant to Section 29 (1) (l) of Paragraph (1) of Article 29 of Government Decree 45/2014 (26.II.), the Guest, as a natural person acting outside the scope of his/her profession, self-employment, or business activity (hereinafter referred to as “consumer”), shall not have the right of cancellation.

Nevertheless, the Service Provider shall ensure that the Guests shall have the right to cancel the booking without giving any reason until the 31st day prior to the start date indicated in the booking, and to withdraw from the contract concluded between the Service Provider and the Guest in accordance with the GTC. If the guest exercises this right of cancellation after the deadline, the amount of the deposit paid shall be considered as a cancellation fee and shall be due to the Service Provider as a cancellation fee and shall not be refunded to the guest.

If the guest wishes to exercise this right of cancellation within the time limit, the guest must send a clear statement of this intention to withdraw (for example, by post or by electronic mail) to one of the following contact details:

For this purpose, you may also use the attached withdrawal/cancellation template, which is included in Annex 1 to the GTC.

The guests exercise their right of cancellation within the time limit if the above cancellation template is sent before the expiry of the time limit indicated above.

10. Legal effects of cancellation:

If the guest cancels the contract within the deadline, we will refund the full amount of the deposit paid by the guest by bank transfer immediately, but no later than 14 days after receipt of the cancellation notice. Any bank charges incurred during the refund shall be borne by the guest.

11. Warranty information

Given that the booking system only allows the conclusion of a contract for the provision of accommodation for a specific delivery date, no warranty or product guarantee claims can be made. However, even in this case, the consumer is still entitled to a right to an implied warranty, as described below:

In which cases can you exercise your right to an implied warranty?

Under the rules of the Civil Code, in the event of a defective performance by the Service Provider, you may claim a right of implied warranty from the Service Provider.

What rights do you have under your claim for implied warranty?

Given that the booking system only allows you to conclude a contract for the provision of accommodation for a specific delivery date, you cannot claim for “replacement” or “repair” due to the nature of the service. You may, however, request a proportionate reduction in the price or, as a last resort, withdraw from the contract.

You may also transfer your right to implied warranty, but you will bear the cost of the transfer, unless it was justified, or the Service Provider gave a reason for it.

What is the deadline for you to exercise your right of implied warranty?

You must notify us of a defect as soon as you discover it, but no later than two months after the defect is discovered. However, you should note that you cannot claim for a defect after the two-year limitation period from the date of performance of the contract.

Who can you claim against?

You can enforce your rights against the Service Provider.

What are the other conditions for exercising your implied warranty rights?

Within six months of the date of performance, your right to claim under the service provider’s guarantee is subject to the condition that you prove that the service was provided by the service provider. However, after six months from the date of performance, you will have the burden of proving that the defect which you have discovered existed at the time of performance.

12.1 If the guest wishes to lodge a complaint against the Service Provider, he/she may address the complaint to the following:

The Service Provider has a legal obligation to cooperate in the conciliation procedure. The Service Provider shall make use of the conciliation procedure in the event of the initiation of the procedure.

12.6 To the court in accordance with the provisions of the Civil Code and the Code of Civil Procedure.

12.7 If the Guest’s habitual residence is in an EU Member State other than Hungary, in the event of a dispute with the Service Provider, the Guest may also use the online dispute resolution platform operated by the European Commission to conduct the dispute resolution procedure. The online dispute resolution platform is available at the following link: http://ec.europa.eu/odr.

13.   Miscellaneous legal information

13.1 The website as a whole constitutes a work of intellectual property, and in particular the documents, information, images, graphics, and visual components of the booking system are protected by law under Act V of 2013 on the Civil Code and Act LXXVI of 1999 on copyright.

13.2 The Internet address (name) of the booking system is protected by copyright and may be used, except for the purpose of reference, only with the written consent of the Service Provider.

13.3 Hungarian law shall apply to any issues not regulated in the GTC and to the interpretation of the GTC.

13.4 The Service Provider is unilaterally entitled to amend the GTC, which will enter into force upon publication on the booking system. The changes will not affect contracts concluded prior to the entry into force (no retroactive effect).

13.5 This GTC shall enter into force on 24 February 2023.
